Does EPLI Cover Privacy Violations?

Triple-I lists privacy violations among EPLI claim examples but cautions that privacy violations caused by a computer breach may not be covered by EPLI. A Travelers specimen includes employment-related invasion of privacy in its wrongful-employment-practice definition, which is narrower than every privacy event. A workplace investigation, personnel-file disclosure, or employee data breach can therefore implicate different policy wording and lines. Check whether the allegation arises from employment practices, whether electronic data or network events are excluded, and how cyber, EPLI, and general-liability forms coordinate. Review the claim definition, exclusions, sublimits, and notice requirements across the actual policies before assuming one responds.
