What Does EPLI Cover?

Often, EPLI covers specified claims such as discrimination, harassment, wrongful termination, and related employment allegations, subject to the policy.

EPLI forms commonly address claims by employees, former employees, or job candidates alleging discrimination, sexual harassment, retaliation, wrongful termination, failure to hire or promote, defamation, or privacy violations. A Travelers sample form defines covered wrongful employment practices to include several of these allegations, but that specimen is one insurer’s form and cannot establish what another quote covers. Defense costs, settlements, and damages are subject to definitions, exclusions, limits, and applicable law. Compare the actual coverage grant and endorsements, claimant definition, defense arrangement, shared or separate limits, retention, and state-specific terms; do not rely on a coverage label alone. A quote can distinguish defense expenses from damages, and defense spending may reduce a shared limit. Read the insuring agreement and declarations together, including any schedule of covered claims.
