Is EPLI Required?

Usually no general federal law requires EPLI, but contracts or particular arrangements may require it; check applicable state rules and agreements.

EPLI is generally a voluntary liability purchase rather than a universal federal mandate. That does not remove an employer’s obligations under employment laws, and a customer, investor, lender, landlord, or contract could require specified insurance as a condition of doing business. Requirements can depend on the contract, public procurement rules, industry, and jurisdiction. Do not confuse EPLI with workers’ compensation, whose legal requirements are set largely by state law and vary. Check every operating state’s rules and any contract’s required coverage, limits, and proof-of-insurance language. Then confirm that an EPLI policy or endorsement actually meets those terms; a certificate alone does not expand policy coverage.
