Does EPLI Cover Defamation?
Often, employment-related defamation may be included in EPLI, but the policy can limit it to defined workplace allegations.
EPLI forms may include employment-related libel or slander allegations. Triple-I lists defamation among possible covered claim types, and a Travelers specimen includes employment-related defamation in its wrongful-employment-practice definition. The modifier matters: a business dispute or public statement unrelated to an employment relationship may fall outside that grant or under different wording. Check the definitions of covered wrongful acts, claimant, and claim; whether alleged statements must arise from hiring, employment, or termination; and any personal-injury, intentional-act, or prior-knowledge exclusions. Compare the defense arrangement and limits with any media or general-liability coverage, since one policy should not be assumed to fill another’s gap.
