Does EPLI Cover Former Employees?
Often, former employees can bring covered EPLI allegations, but the alleged act’s timing and the policy’s claimant definition still matter.
Former employees are among the claimant groups described in Triple-I’s EPLI overview, and a Travelers sample form expressly includes past employees. That does not mean every claim arising after termination is covered. The alleged wrongful act, when the claim was first made, retroactive date, prior knowledge, notice, and related-claims wording may determine which policy responds. Some acts may be excluded or fall outside the insured period even when the claimant qualifies. Check the policy definitions for past employees and employment claims, the prior-and-pending matter provisions, and any extended reporting option if coverage ends. Report a written demand or administrative charge according to the policy’s notice clause.
