Does EPLI Cover Third-Party Claims?

Only if the policy includes third-party EPLI coverage for claims by nonemployees, typically subject to a separate definition or endorsement.

Some businesses face discrimination or harassment allegations from customers, vendors, or other people who are not employees or applicants. A Travelers sample EPLI form makes third-party claim coverage conditional on the declarations showing it applies, illustrating why a general EPLI label is not enough. The covered third-party acts and claimant definition may be narrower than employee coverage, and a separate sublimit or retention may apply. Check the declarations for the extension and read its definitions, covered allegations, territory, limits, exclusions, and notice terms. If the quote lists only employee EPLI, ask whether third-party allegations are included or can be added before relying on it.
