Does EPLI Cover Failure to Hire?

Often, failure-to-hire allegations are addressed by EPLI, but applicant status, alleged basis, and policy terms matter.

Employment candidates can bring allegations involving a hiring decision. Triple-I lists failure to employ as an EPLI claim type, and a Travelers specimen includes applicants in its claimant definition and failure or refusal to hire in its discrimination wording. Those terms are not universal. The form may define applicants, protected classes, and covered wrongful acts narrowly, while prior acts, notice, and other exclusions can affect a claim. Check whether applicants and prospective employees are insured claimants under the offered wording, whether the alleged hiring practice fits the coverage grant, and whether state or local extensions apply. Compare any separate applicant or third-party limits and required claim-reporting steps.
