What to Watch for in Virginia
Virginia recognizes a driver’s policy for non-owned vehicles
Section 46.2-472 requires a driver’s policy to cover liability arising from use of a motor vehicle the insured does not own, within owner-policy limits. Ask whether the employee’s policy is an operator policy and whether it reaches business use. 1
Virginia requires consent coverage in owner policies
Section 38.2-2204 requires owner auto policies to insure other people using or responsible for use with express or implied consent. Document permission for work use and confirm your company’s own liability protection separately. 2
Employee coverage does not automatically insure the employer
The driver’s policy described by § 46.2-472 insures the named driver. Ask the broker whether the employer is also an insured under HNOA when named in a suit over the employee’s authorized work trip. 1
