North Carolina Hired and Non-Owned Auto Coverage
North Carolina requires each vehicle rented to the public to carry liability insurance covering the renter, lessee, and their agents and employees while performing their duties. In a lawsuit, vehicle registration is also prima facie evidence of owner permission and control, a fact that matters when employees use company or borrowed vehicles. 2,1
What Is Hired And Non-Owned Auto?
Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. Read the national Hired and non-owned auto guide.
What to Watch for in North Carolina
A commercial rental must carry liability insurance
G.S. 20-281 requires each rented or leased vehicle to be covered for the owner and renter, and their agents and employees while performing duties. Ask how the rental contract’s insurance coordinates with your hired-auto policy and whether the employee is an authorized driver. 1
Registration creates a rebuttable evidence issue
In a North Carolina motor-vehicle lawsuit, proof of ownership is prima facie evidence of permission, while registration can be prima facie evidence of ownership, control, owner benefit, and employment scope. Keep trip-purpose and authorization records and ask the broker whether HNOA responds to alleged employer liability. 2
The rental statute sets its own minimums
G.S. 20-281 specifies $50,000 per injured person, $100,000 per accident, and $50,000 property damage for covered rentals. These are rental-company minimums, not a recommended limit for your employer’s exposure; compare them with your own limits. 1
Who Regulates Insurance in North Carolina

Surplus-lines tax and stamping office
Reported tax rate: 5% of gross premium, less return premium, plus 0.4% NC Stamping Office fee for ordinary filed placements When North Carolina is the insured’s home state, surplus-lines tax is 5% of gross premium less return premium; ordinary broker-placed filings also carry a 0.4% stamping fee, while risk-purchasing-group and independent-procurement filings follow separate procedures. A diligent search is generally required; an exempt commercial purchaser may bypass it only after the broker discloses the admitted-market protection difference and receives the purchaser’s subsequent written request. The policy warns that the state guaranty or solvency fund will not pay surplus-lines losses. 7,8,9,10

Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm the product is available in North Carolina. Check the regulator’s license lookup and confirm state availability for your business when requesting a quote.
