What to Watch for in Wyoming
Wyoming created a qualified developer-liability limitation
Under the new § 1-1-143, a developer generally is not liable for damages arising when another person uses an AI system intending illegal or illicit activity or harm. The limitation does not apply when the system was developed with knowledge or intent that its primary purpose would be illegal or illicit activity. This state-specific rule can affect how a developer’s liability program evaluates underlying allegations. 1
Wyoming targets systems purpose-built for child sexual material
Section 6-4-308 applies when a person knowingly develops or distributes an AI system specifically designed to create, distribute, or promote child pornography or synthetic sexual material, with intent or knowledge that others will use it for child pornography. Subsection (c)(i) excludes a system that produces child-pornography-promoting content solely because of user prompts or inputs and without the developer’s intent to encourage or promote it. The statute also lists institutional, law-enforcement, and service-provider exceptions; assess the exact design, knowledge, and exception facts. 1,2
AI use does not excuse an underlying Wyoming offense
Wyoming added that use of an AI system is not a defense to a criminal charge and that criminal code prohibitions apply to activity facilitated by AI. The enacted law also includes separate offenses for systems intended to promote self-harm; map those risks apart from ordinary model errors or inaccurate outputs. 1,2
Wyoming separately regulates knowing consumer misrepresentations
W.S. § 40-12-105 prohibits specified knowing misrepresentations about a product’s source, origin, sponsorship, approval, or uses in connection with a consumer transaction. Substantiate marketing claims about an AI system’s approval, provenance, or capabilities and distinguish those sales-practice allegations from the child-safety crimes in Act 32. 3
