Generative AI Liability Insurance in Nevada

Nevada’s 2025 revision of NRS 200.770 includes photorealistic, digital, computer, or computer-generated images that a reasonable person would believe depict intimate anatomy or sexual conduct of an identifiable person. NRS 200.780 makes specified nonconsensual electronic dissemination or sale a category D felony when done to harass, harm, or terrorize and the person had a reasonable expectation of privacy. NRS 200.785 separately addresses demands for payment or value in exchange for removing an intimate image. 1,2

What to Watch for in Nevada

  • The 2025 definition no longer requires an actual body part

NRS 200.770 now covers qualifying photorealistic or computer-generated images a reasonable person would believe depict an identifiable person’s intimate anatomy or sexual conduct, even where the image does not depict that person’s actual body. The public-figure and other statutory exclusions still matter. 1

  • Nevada’s offense is tied to intent and privacy expectation

Section 200.780 requires intent to harass, harm, or terrorize; no prior consent; a reasonable expectation that the image stay private; and that the depicted person was at least 18 when the image was created. Evaluate each element before treating an image report as a covered offense. 1

  • A removal demand is a separate offense

NRS 200.785 addresses demands for money or other consideration in exchange for removing an intimate image. A response plan should flag payment demands and preserve them separately from the original disclosure, since the conduct may create another statutory exposure. 1

  • Nevada separately addresses false claims about services

NRS 598.0915 treats specified knowing false representations about the source, sponsorship, approval, certification, characteristics, uses, or benefits of goods or services as deceptive trade practices. Substantiate claims about an AI system’s provenance, certification, or capabilities and review them separately from intimate-image content controls. 2

Surplus-lines tax and stamping office

Reported tax rate: Same tax rate as admitted coverage of the same kind; an approved filing fee may also apply When Nevada is the insured’s home state, Nevada taxes surplus-lines coverage at the rate imposed on similar admitted coverage and adds any approved filing fee; the rate therefore depends on the line and applicable fee approval. Nevada law requires a diligent effort to place coverage with authorized insurers except where the statutory exempt-commercial-purchaser conditions apply, and the policy must warn that the Nevada Insurance Guaranty Association will not cover the contract. 6,7,8,9

Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.
