  • Digitally altered images can identify someone even if they did not pose

    Section 573.570 defines a depicted individual as someone who appears in whole or part in an intimate digital depiction as a result of digitization or digital manipulation and is identifiable by likeness or related information. The law defines intimate depictions by specified sexual anatomy or conduct and prohibits covered disclosures without consent under its stated elements. Separate generation, moderation, and distribution roles when notifying a broker. 1

  • A disclaimer does not cure a covered disclosure

    Missouri expressly provides that a notice saying the depiction was unauthorized or that the person did not participate in its creation is not a defense to the disclosure offense. A watermark or “AI-generated” label can support transparency but should not replace consent checks, access controls, or a removal path for disputed intimate content. 1

  • Check which statute governs the image and effective date

    Missouri separately provides a private cause of action for nonconsensual dissemination of private sexual images under § 573.110, with statutory damages and attorney fees. The legislature’s 2026 section addresses intimate digital depictions expressly and has its own effective date and elements. Ask the broker and counsel to map the asserted cause of action and policy period instead of assuming the older provision and new one are interchangeable. 2,1
