What to Watch for in Washington

  • Washington expressly treats AI alteration as digitization

    RCW 9A.86.030 defines digitization to include creating or altering an image using AI. Its fabricated-intimate-image offense covers an identifiable person shown with another or computer-generated intimate body parts, or in sexual activity in which they did not engage, where the accused knowingly discloses the image under the section’s elements. First offenses are gross misdemeanors; a qualifying prior conviction makes the offense a class C felony. 1

  • Written consent must describe the image and any audiovisual work

    For the fabricated-image civil claim, Washington treats consent as valid only when a plain-language agreement is knowingly and voluntarily signed and includes a general description of the image and, if applicable, the audiovisual work. Consent to creation alone does not establish consent to disclosure. Keep permissions linked to each use and recipient rather than relying on a broad product-account acceptance. 2

  • A label does not defeat the Washington civil claim

    Washington says a disclaimer that an image was unauthorized or that the depicted person did not participate in its creation is not a defense to the civil action. Removing or labeling an output is not a substitute for authorization, and the statute preserves other remedies. Ask how the insurer treats costs of response, takedown, and civil defense when the user disputes consent. 2
