Generative AI Liability Insurance in Iowa
Iowa Code § 659A.3 allows an identifiable person harmed by intentional, nonconsensual disclosure or threatened disclosure of a private intimate image to bring a civil action when the defendant knew or recklessly disregarded specified facts. Consent to create an image or prior consensual sharing does not by itself establish consent to later disclosure. Separately, § 728.12 includes images created, adapted, or modified to make an identifiable minor appear to engage in prohibited sexual acts, without requiring proof of the minor’s actual identity. 1,2

What to Watch for in Iowa
Iowa preserves privacy even after an image was made in public
Section 659A.3 states that a depicted person retains a reasonable expectation of privacy if they did not consent to the sexual conduct or exposure shown, even when the image was created in a public place. Consent to creation and prior sharing also do not alone establish consent to later disclosure. 1
The civil cause of action includes threats to disclose
Iowa’s civil statute reaches intentional disclosure or threatened disclosure of an intimate image that was private, where the depicted person is identifiable and suffers harm and the defendant knew or recklessly disregarded the required facts. Preserve private messages and access histories alongside any posted media. 1
Iowa’s minor-exploitation law expressly reaches altered depictions
Section 728.12 includes images adapted or modified to appear that an identifiable minor is engaged in a prohibited sexual act, and states that proof of the minor’s actual identity is not required. The definition concerns an identifiable minor or a minor image used in making the depiction, so distinguish this rule from wholly fictional content. 2
Who Regulates Insurance in Iowa

Iowa Insurance Division
The Iowa Insurance Division licenses insurance producers and maintains separate lists for licensed insurers and surplus-lines insurer categories. Its filing page routes most rate, rule and form filings through SERFF and identifies filings requiring prior approval; eligible surplus-lines insurers are not required to file or seek approval of their rates or forms. 3,9,8,4,5
Surplus-lines tax and stamping office
Reported tax rate: 0.925% of surplus-lines premiums when Iowa is the insured's home state, for 2026 When Iowa is the insured's home state, the 2026 premium tax is 0.925%, and the surplus-lines producer shall collect and pay it to the state in addition to gross premium. Placement generally requires an eligible surplus-lines insurer and a diligent search showing the full amount or type is unavailable from an admitted insurer; an exempt commercial purchaser may bypass that search only after the producer discloses that admitted insurance may be available and may offer greater protection and oversight, then the purchaser subsequently requests surplus-lines placement in writing. 6,7
Providers With Documented State Licenses
No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.
