Generative AI Liability Insurance in Louisiana

Louisiana Revised Statutes § 14:73.15 makes unauthorized possession of certain AI-created nude or partially undressed images of a recognizable person under 17 unlawful when the possessor knows or has reason to know they lack authorization. A separate statute addresses intentional disclosure of identifiable private sexual images, with defined elements and an interactive-service exception for third-party content. 1,2

What Is Generative AI Liability?

If you use or sell AI outputs, check how the policy fits your role and existing liability coverage. Read the national Generative AI liability guide.

What to Watch for in Louisiana

  • Possession itself can be the alleged offense

Louisiana § 14:73.15 is not limited to publishing or selling. It covers possession of an AI-created still or video depicting a recognizable person under 17 who is totally nude or undressed to expose specified body areas, when the possessor knows or has reason to know they are not authorized to possess it. Review moderation, storage, escalation, and deletion controls for user uploads and generated outputs, then ask whether the policy addresses defense of possession allegations. 1

  • Disclosure claims have separate privacy and intent elements

Under § 14:283.2, the state offense requires an identifiable image showing intimate parts or sexual conduct, acquisition through unauthorized access or circumstances indicating privacy, lack of consent, and knowledge or reason to know of likely harassment or emotional distress. The cited statute does not say every synthetic likeness meets those elements; document how a complained-of image was generated, obtained, shared, and labeled. 2

  • The statutory service-provider provision is narrow

Section 14:283.2 says it does not impose liability on an interactive computer, information, or telecommunications service for content provided by another person. That clause is tied to this offense and third-party content; it does not resolve every state-law claim or the liability of a service that creates or materially changes an image. Separate hosting, generation, moderation, and distribution roles in the application materials. 2

Questions to Ask Before You Buy in Louisiana

  1. Can users submit or generate sexual images of real people under 17, and what controls prevent unauthorized possession, retention, or distribution?
  2. Does your service create the image, host a user upload, or merely transmit third-party content, and what records establish each role?
  3. Does the quote address criminal-investigation response, privacy or publicity claims, defense costs, and exclusions tied to sexual or unlawful conduct?

Generative AI Liability in Louisiana: FAQ

Does Louisiana’s AI-image statute apply to every synthetic image? 1

No. Section 14:73.15 concerns possession of AI-created images meeting its age, nudity, recognizability, and authorization conditions. It is not a general rule governing all generated text, images, or model output. 1

Does Louisiana’s third-party-content clause protect every AI platform? 2

No. The clause in § 14:283.2 concerns liability under that section for content provided by another person. It does not decide liability under other laws or for content the service itself creates. 2
