Texas law requires the consumer notice no later than the 60th day after breach determination, while a breach involving at least 250 residents requires an electronic AG filing no later than day 30 after determination. Only an Authorized Business Representative Files the AG Form
The Texas AG says its online breach report must be submitted by an authorized representative and cannot be saved partway through, so it should be completed in one sitting. Identify that authorized filer and gather the incident details in advance; the AG form may also be subject to public-record requests. 2
Texas Counts Encrypted Data if the Key Was Obtained
The Texas definition of breach includes encrypted data when the unauthorized person has the key needed to decrypt it, and sensitive personal information includes some health information. Ask the forensic team to record key access and compromised fields instead of closing the Texas analysis based only on encryption status. 1
More Than 10,000 Notices Adds Nationwide Agencies
A person required to notify more than 10,000 people at one time must also notify nationwide consumer-reporting agencies without unreasonable delay. Ask your broker whether response services count this threshold independently from the 250-person Texas AG trigger. 1
