Resident Notice Uses an Expedited Standard
Minnesota requires notice in the most expedient time possible without unreasonable delay, consistent with investigation, identifying affected people, and restoring system integrity. Keep the incident timeline and affected-population analysis available to support that decision. 1
Check the Financial-Institution Exemption
Minnesota’s §325E.61 does not apply to a financial institution as defined by the federal Gramm-Leach-Bliley Act. Ask counsel which entity holds the affected data and whether it qualifies; the exemption should not be assumed for a separate vendor or affiliate. 1
