The AG Filing Follows Resident Notice
If 500 or more Oklahoma residents are affected, an entity that must notify residents must send the Attorney General a report without unreasonable delay and no later than 60 days after providing resident notice. The filing includes breach and determination dates, breach nature, data types, resident count, estimated monetary impact when determinable, and safeguards; ask who owns this second deadline and gathers those fields. 1,2
Exposed Keys and Authentication Biometrics Count
The amended definition reaches biometric data used to authenticate a specific person, and encrypted or redacted information when the breach also obtains the keys needed to read it. Inventory authentication templates and key-management access with other affected data before deciding whether Oklahoma notice is required. 1
The Law Requires Access and Acquisition
Oklahoma’s qualifying breach definition requires unauthorized access and acquisition of computerized data in a database about multiple people, plus actual or reasonably believed identity theft or fraud; encrypted data alone is not enough unless access to its key triggers the rule.
