Crime insurance in New Hampshire: check employee and payment-order definitions

What to Watch for in New Hampshire
Tell the broker who handles instruments
RSA 382-A:3-405 includes an independent contractor and an employee of an independent contractor retained by the employer within “employee” for its fraudulent-endorsement rule. Responsibility includes signing, processing, preparing, supplying payee information, and controlling instruments; mere access to stored, transported, or mailed checks is excluded. This commercial-law allocation does not prove that a contractor meets your policy's employee definition or that a resulting loss is covered. 1
Confirm more than a known address with the bank
RSA 382-A:4A-201 defines a security procedure as one established by agreement with the receiving bank and says signature comparison or requiring orders from a known email, IP address, or phone number alone is not a security procedure. The operative text reflects 2022 chapter 281, §27, effective January 1, 2023. Ask the bank for the entire procedure and review any insurer verification condition separately. 2
Report a suspected transfer loss without waiting
RSA 382-A:4A-204 sets a customer-bank notice rule for unauthorized payment orders: failure to use ordinary care and notify the bank within a reasonable time capped at 90 days after bank notice removes interest on a refund, while late notification alone does not entitle the bank to recover from the customer. That rule does not set the policy's claim deadline. The FBI advises immediate bank contact and an IC3 report for BEC. 3,4
