Iowa Crime Insurance Guide

An Iowa check loss and a fraudulent wire are different problems to map before renewing crime insurance. Iowa includes retained independent contractors in the employee rule for certain forged check endorsements, requires prompt review of paid items, and gives a customer no more than 60 days to catch later items by the same wrongdoer after a reasonable review period; the outside bank deadline is one year. For wires, Iowa says a known email address or phone number alone is not a security procedure. These bank-payment rules do not promise insurance recovery. 1

What to Watch for in Iowa

  • Map who has responsibility for checks

    Iowa Code § 554.3405 includes a retained independent contractor and the contractor’s employee in its definition of employee for this specific check-endorsement rule. Responsibility can include processing deposits, preparing issued checks, choosing payees, or controlling checks; access to blank forms alone is excluded. Ask the broker how the policy defines covered employees and addresses outsourced bookkeeping or payment work. 1

  • Reconcile statements on a schedule

    Under § 554.4406, a customer must examine available statements or items with reasonable promptness and notify the bank promptly about an unauthorized signature or alteration. For later items by the same wrongdoer, the statute sets a reasonable review period of no more than 60 days; an outside one-year limit also applies to asserting the issue against the bank. Neither period is an insurer notice extension. 1

  • Check the bank’s actual verification procedure

    Iowa §§ 554.12201–.12202 distinguish an agreed security procedure from a familiar sender address: requiring orders from a known email address, IP address, or phone number is not by itself a security procedure. Review the bank agreement and callback or other verification steps, then ask separately whether the quote responds when staff send a real wire after a spoofed instruction. 1,2

Who Regulates Insurance in Iowa

Iowa Insurance Division

The Iowa Insurance Division licenses insurance producers and maintains separate lists for licensed insurers and surplus-lines insurer categories. Its filing page routes most rate, rule and form filings through SERFF and identifies filings requiring prior approval; eligible surplus-lines insurers are not required to file or seek approval of their rates or forms. 3,9,8,4,5

Placement generally requires an eligible surplus-lines insurer and a diligent search showing the full amount or type is unavailable from an admitted insurer; an exempt commercial purchaser may bypass that search only after the producer discloses that admitted insurance may be available and may offer greater protection and oversight, then the purchaser subsequently requests surplus-lines placement in writing. 6,7

No. Section 554.4406 concerns asserting unauthorized signatures or alterations against a bank. Follow the separate notice and proof requirements in the insurance policy. 1

Is a familiar email address enough to verify a wire under Iowa law? 1

No. Section 554.12201 says that requiring a payment order from a known email address, IP address, or phone number is not by itself a security procedure. Review the full procedure agreed with the bank and the policy wording separately. 1
