Illinois Crime Insurance Guide

Illinois businesses that give employees or retained contractors check-processing responsibility should compare employee-dishonesty and forgery terms against that workflow. Illinois’s Uniform Commercial Code treats an entrusted worker’s fraudulent indorsement as effective in specified circumstances and requires prompt review of paid items; banks must retain or be able to furnish legible copies for seven years. What to Watch for in Illinois

  • Include retained contractors in the control map

    Under 810 ILCS 5/3-405, employee includes an independent contractor and an employee of a retained contractor. The section focuses on entrusted responsibility for instruments, including processing incoming checks or preparing checks for issue. Ask how the quote defines covered employees and whether a vendor that handles receivables or disbursements is addressed. 1

  • Preserve paid-item records and review them promptly

    Illinois law requires prompt examination of bank statements or items for unauthorized signatures and alterations. When the bank does not return the items, § 4-406 requires it to retain them or maintain the ability to furnish legible copies for seven years. Assign a reviewer and preserve available images, statements, and approval records; do not confuse this bank-record rule with an insurer’s proof or notice requirements. 2

  • Separate check forgery from a deceived wire payment

    A vendor email that redirects a wire is a different transaction from a forged check. The FBI describes compromised email and fraudulent payment instructions as business-email compromise and recommends immediate bank contact. Ask for the quote’s specific social-engineering or funds-transfer wording rather than assuming a check provision responds. 3

Who Regulates Insurance in Illinois

Illinois Department of Insurance

The Department licenses and oversees insurers and insurance producers doing business in Illinois, reviews regulated insurance activity, and investigates complaints about coverage, claims, premiums, and sales. 4,6,5

Reported tax rate: 3.5% of taxable premium plus a 0.04% stamping fee; separate 1% fire marshal tax on taxable fire premium When Illinois is the insured’s home state, the broker reports and remits a 3.5% tax on gross taxable surplus-line premium less returned taxable premium.   • Illinois guaranty fund limits: For covered claims against a member insurer, the Illinois Insurance Guaranty Fund generally caps its obligation at $500,000 per claim; workers’ compensation claims are excepted from that dollar cap.
