What to Watch for in Nebraska
Filing treatment depends on class and threshold
Class RFS is an account-level test, not a small-business BOP shortcut: one route requires a qualifying risk manager, at least $100,000 in annual aggregate commercial P&C premiums, and at least two additional size tests (including premium, net worth, revenue, employee or public/nonprofit budget tests). Other RFS routes and RF/R thresholds differ. Ask for the specific route and calculation. 1
Form relief and rate relief are not interchangeable
Form and rate relief differ by class. RFS and RF can be exempt from filed-rate and approved-form requirements for commercial P&C policies; Class R receives rate relief only. RFS also has a limited surplus-lines access exemption, with workers’ compensation and auto exceptions. Ask which relief the insurer applies to this BOP. 1
Related insureds may affect threshold calculation
Exempt status is optional, and unrelated entities cannot be combined to reach a threshold. Where a form is not director-approved, the insurer must notify an exempt policyholder no later than 30 days after coverage starts. Request the classification basis and any non-approved forms before comparing limits. 1
