IDOI’s current checklist cites 215 ILCS 5/801.1: policies issued or renewed that insure a commercial building on a direct basis include separately stated mine-subsidence coverage in 34 high-exposure counties unless the insured waives it in writing; in other counties, insurers must provide it on request. Ask the agent to identify the county treatment, premium and any signed waiver. The cited rule concerns commercial buildings; do not assume it insures stock or business income. 3
Compare the building and contents valuation separately
IDOI defines actual cash value as replacement cost less depreciation and describes coinsurance as a required amount of insurance. Reconcile building, permanently attached equipment and business personal property against separate quote limits; the mine-subsidence provision for a commercial building does not answer the valuation or contents questions. 2,3
Keep liability and interruption comparisons distinct
The BOP package addresses different risks: liability claims from others, damage to your own property and potential lost income after a covered disruption. Ask what event triggers the income section, its waiting and payment periods, and whether the declared cause of loss would apply to the affected location; Illinois’s mine-subsidence building provision does not establish business-income coverage. 1,3
