Texas Business Owner’s Policy Guide

In Texas, compare the causes of loss and valuation behind a BOP quote, not just its premium. The Texas Department of Insurance explains that special-form property still has exclusions, replacement-cost and actual-cash-value settlements differ, and business-income or extra-expense payments depend on the protection included in your policy. 1,2

What Is Business Owner’S Policy?

A BOP may suit an eligible small business that wants property, liability and lost-income protection together. If you also need auto, workers’ compensation or professional liability, plan for separate coverage. Read the national Business owner’s policy guide.

What to Watch for in Texas

  • A broader property form still has named exclusions

TDI says special-form property generally covers causes of loss except those listed as exclusions, and most policies exclude flood and earth movement. Ask for the actual causes-of-loss form and identify which excluded perils need separate protection at each location. 1

  • Review coastal wind and hail as a separate placement

TDI says a business on the Texas coast or in Harris County on Galveston Bay may not have wind and hail in its policy; TWIA offers coverage for coastal residents and businesses, but location rules apply and a Gulf hurricane can pause new sales. Ask the agent whether your address needs TWIA and whether flood insurance must be in place first. 1

  • Check replacement cost and underinsurance exposure

TDI distinguishes replacement cost from actual cash value, which subtracts depreciation and may not fund a full rebuild. Confirm the valuation basis for the building, inventory and equipment, and update values after renovations or purchases. 1

  • Read income and civil-authority wording

TDI says a business-income or extra-expense loss after physical damage depends on those coverages being included; a closure without direct damage due to an evacuation order may depend on civil-authority wording. Ask about the trigger, waiting period, covered expenses and temporary-location costs in the issued form. 2

Who Regulates Insurance in Texas

Texas Department of Insurance

TDI licenses agents and insurers, reviews company rate filings, and investigates complaints against insurance companies and people it regulates. Its complaint page states limits on what it can resolve, including disputes outside its regulatory authority. 3,4,5

Surplus-lines tax and stamping office

Reported tax rate: 4.85% of gross premium plus 0.04% SLTX stamping fee When Texas is the insured’s home state, the state tax is 4.85% of gross premium; absent a compact allocation agreement, a multistate policy can be taxed on its entire premium. Policies effective on or after Jan. 1, 2024 also carry a 0.04% stamping fee; SLTX invoices the broker and says the insured pays it, and the surplus-lines insurer is not covered by the Texas guaranty association. 6,7,8

Providers With Documented State Licenses

These providers publish a national listing for Business owner’s policy; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm the product is available in Texas. Check the regulator’s license lookup and confirm state availability for your business when requesting a quote.

  • CorgiCorgi Insurance Services, Inc.Insurance producer · checked 2026-09-28Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability. 11
  • ERGO NEXT InsuranceNext First Insurance Agency, Inc.Insurance producer · checked 2026-09-28ERGO NEXT’s current license table lists Next First Insurance Agency, Inc. in 50 jurisdictions, including Washington, DC; New York is excluded because its table rows name Next Insurance Services and AP Intego, not Next First. The table is company-reported; it does not establish product availability or provide state-regulator verification for each entry. 13
  • HiscoxHiscox Insurance Company Inc.Insurer · checked 2026-09-28Hiscox’s U.S. company information states that Hiscox Insurance Company Inc. is licensed in all 50 states and the District of Columbia. This is company-reported insurer authority for this entity and does not establish which company issues every Hiscox-branded product. 12
  • TechInsuranceSpecialty Program Group LLCInsurance producer · checked 2026-09-28TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map. 15

Questions to Ask Before You Buy in Texas

  1. Does a coastal address need a separate TWIA wind-and-hail policy, and is flood coverage a prerequisite at that location?
  2. Are property values settled at replacement cost or actual cash value, and how are inventory and newly acquired property handled?
  3. Does the income protection cover evacuation orders or utility interruption without direct damage at the premises?

Business Owner’S Policy in Texas: FAQ

Should I list every worksite when quoting a Texas BOP? 1

Yes. TDI specifically advises businesses to tell the agent about all worksites to make sure the locations are covered. Include storage, temporary premises and other operating addresses for review. 1

How should I compare two Texas package quotes? 1

TDI advises comparing similar coverages rather than price alone because a cheaper policy may provide less coverage. Line up limits, deductibles, property forms, income triggers and locations before comparing premiums. 1
