# Nebraska Business Owner’s Policy Guide

Nebraska’s exempt-commercial-policyholder rule can change form and rate filing treatment for large property-and-casualty accounts, and for some classes it changes access to surplus-lines coverage. The highest RFS route requires a qualifying risk manager and substantial account thresholds; status is optional and unrelated entities cannot be combined. Ask the carrier which class, if any, applies to the full account before comparing BOP forms.[^1][^2]

**Coverage:** [Business owner’s policy](/coverage/business-owners-policy) · [Nebraska](/coverage/states/nebraska)

## What Is Business Owner’S Policy?

A BOP may suit an eligible small business that wants property, liability and lost-income protection together. If you also need auto, workers’ compensation or professional liability, plan for separate coverage. [Read the national Business owner’s policy guide](/coverage/business-owners-policy).

## What to Watch for in Nebraska

### Filing treatment depends on class and threshold

Class RFS is an account-level test, not a small-business BOP shortcut: one route requires a qualifying risk manager, at least $100,000 in annual aggregate commercial P&C premiums, and at least two additional size tests (including premium, net worth, revenue, employee or public/nonprofit budget tests). Other RFS routes and RF/R thresholds differ. Ask for the specific route and calculation.[^1]

### Form relief and rate relief are not interchangeable

Form and rate relief differ by class. RFS and RF can be exempt from filed-rate and approved-form requirements for commercial P&C policies; Class R receives rate relief only. RFS also has a limited surplus-lines access exemption, with workers’ compensation and auto exceptions. Ask which relief the insurer applies to this BOP.[^1]

### Related insureds may affect threshold calculation

Exempt status is optional, and unrelated entities cannot be combined to reach a threshold. Where a form is not director-approved, the insurer must notify an exempt policyholder no later than 30 days after coverage starts. Request the classification basis and any non-approved forms before comparing limits.[^1]

### Filing status does not define the protection

Filing status does not define the protection. Nebraska’s DOI organizes commercial fire, general-liability and commercial-multi-peril filing materials separately. Compare the BOP’s property and liability parts directly; an exemption is not a coverage grant or an availability decision.[^2][^1]

## Who Regulates Insurance in Nebraska

**Nebraska Department of Insurance.** The Nebraska Department of Insurance oversees insurers and producers and examines insurance complaints. Its online company and producer search is maintained through State Based Systems.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium charged, less return premiums Nebraska’s 3% tax applies to gross premium charged less return premium when the risk is Nebraska’s home-state placement; fees paid to the carrier are taxable, while broker-retained or third-party fees are not. A Nebraska-licensed surplus-lines producer ordinarily must complete due diligence, while exempt-commercial-purchaser provisions permit limited exceptions; federal ECP status alone does not erase the disclosure and subsequent written-request conditions for the federal search waiver. Nebraska policies state that its Property and Liability Guaranty Association will not cover surplus-lines claims.[^6][^7][^8][^9]

## Providers With Documented State Licenses

These providers publish a national listing for Business owner’s policy; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Nebraska; [check the regulator’s license lookup](https://doi.nebraska.gov/company-and-producer-search) and confirm state availability for your business when requesting a quote.

- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^12]
- [ERGO NEXT Insurance](/insurance-providers/next-insurance) — **Entity:** Next First Insurance Agency, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** ERGO NEXT’s current license table lists Next First Insurance Agency, Inc. in 50 jurisdictions, including Washington, DC; New York is excluded because its table rows name Next Insurance Services and AP Intego, not Next First. The table is company-reported; it does not establish product availability or provide state-regulator verification for each entry.[^14]
- [Hiscox](/insurance-providers/hiscox) — **Entity:** Hiscox Insurance Company Inc.; **role:** Insurer; **checked:** 2026-09-28. **Scope:** Hiscox’s U.S. company information states that Hiscox Insurance Company Inc. is licensed in all 50 states and the District of Columbia. This is company-reported insurer authority for this entity and does not establish which company issues every Hiscox-branded product.[^13]
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^15]

## Questions to Ask Before You Buy in Nebraska

1. Does the account meet Class RFS, RF or R criteria, and which route, premiums and size tests support the classification?
2. Does the chosen class change form filing, rate filing, surplus-lines search requirements, or more than one of these?
3. Are covered entities under common ownership, and has the policyholder elected exempt treatment?
4. Will the insurer identify any policy forms not approved by the director before binding?

## Business Owner’S Policy in Nebraska: FAQ

### Are Nebraska BOPs exempt from form filing?

Only if the account qualifies as a defined exempt-commercial-policyholder class and the parties use that optional status. RFS and RF may receive form and rate relief; Class R receives rate relief. Ask which threshold route applies.[^1]

### Does an exemption mean a form is approved or more protective?

No. The Nebraska DOI describes commercial lines filing categories, and the rule distinguishes rate from form exemptions. Neither establishes which terms your policy contains.[^1][^2]
