At-Bay vs
Beazley
Compare At-Bay and Beazley technology coverage for software service credits, contractual liability and security-service costs.
Introduction
A SaaS vendor negotiating an uptime commitment should distinguish a service credit promised in its contract from a credit used to settle an insured claim. At-Bay’s Tech E&O page describes service credits issued to settle a claim as payable damages, subject to terms. Beazley’s MediaTech sample includes contractual restrictions. The useful comparison is how each current proposal treats the actual remedy clause. 2 16

Key Differences Between at-Bay and Beazley
A Settlement Feature Is Not an Uptime Warranty
At-Bay markets combined professional liability and cyber protection, including failed implementations and customer contractual indemnity. Those highlights do not establish unconditional reimbursement of every service credit. Beazley’s older sample is also insufficient to determine the current quote. Ask both underwriters to explain when credits count as damages, whether consent is required and how contractual liability exclusions apply. 2 16 14
A larger requested limit may also change the submission route. At-Bay’s current product page has higher overall appetite ceilings than its broker-platform ceilings, and it advertises specialist excess Tech E&O. Beazley’s marine excess catalogue entry cannot be used to infer equivalent technology excess capacity. Identify the primary and excess terms separately. 2 6 31
Older Appetite Documents Can Mislead an AI Vendor
At-Bay’s accessible legacy appetite guide lists restrictions, including autonomous AI, that should not be promoted into current eligibility conclusions when newer product information differs. Beazley’s public sample and application are older too. For an agentic product, obtain the applicable current appetite and form versions rather than relying on either archived document to declare acceptance or rejection. 12 2 16 15
At-Bay’s historical move to its own E&S insurer does not identify every current issuer. Neither company’s general disclosures establish California acceptance for a particular applicant. Put the legal insurer and producer route on the proposal before comparing premiums. 11 5 18
Security Costs Belong Beside the Premium
At-Bay Stance access is tied to an Embedded Security Fee and Endorsement; optional MDR is a separate purchase from its security affiliate. Beazley’s FullSpectrum Cyber page describes security and vendor services, but does not establish identical benefits for every MediaTech policy. Ask which quoted product includes each service and whether existing security tools qualify for any conditional enhancement. 7 22 14
What to Confirm in Quotes
- When can a service-credit settlement be covered, and whose consent is needed before offering it? 2 16
- Which current appetite, issuer and primary/excess route apply to the AI-enabled product in California? 2 5 18
- What security fees, optional subscriptions and non-cyber E&O reporting duties accompany the policy? 7 8 21
Service Comparison
At-Bay vs Beazley: documented services and availability
| Criteria | At-Bay | Beazley |
|---|---|---|
| Coverage lines | At-Bay describes Tech E&O as combining professional liability and cyber protection, including coding errors, failed implementations and customer contractual indemnity. It also describes service credits issued to settle a claim as payable damages, subject to policy terms. 2 At-Bay markets cyber coverage for direct and contingent business interruption and system failure, cyber extortion, privacy liability, and financial fraud exposures such as social engineering and invoice manipulation. Specific limits and conditions require the quote and policy. 3 At-Bay markets miscellaneous professional liability (MPL) on a primary basis for businesses of all revenue sizes, with limits up to $5 million and state restrictions. The product page describes claims-made-and-reported coverage, a duty to defend and a tailored definition of professional services. 4 At-Bay advertises excess Cyber and Tech E&O alongside primary coverage. The excess catalogue entry refers to those specialist lines; it does not establish a general commercial umbrella offering. 3,2 | MediaTech combines technology and professional errors and omissions, media liability and cyber coverage. Beazley lists breach response, business interruption, dependent business interruption, extortion, data recovery and eCrime protections, with limits up to $5 million; the issued policy determines the cover purchased. 14 The linked MediaTech sample form is dated February 2019. It excludes patent infringement and trade-secret misappropriation related to technology or other products, and contains contractual-liability and retroactive-date restrictions. The sample is not evidence of the wording that will be offered today. 16,18 Execuguard offers private-company directors and officers, employment practices and fiduciary liability, with separate or shared limits across selected coverages. Beazley advertises both admitted and non-admitted options; state and account eligibility still need confirmation. 23 Beazley offers Commercial Crime for commercial companies and Financial Fidelity Bonds for financial institutions. Its crime page describes fraudulent-instruction coverage subject to out-of-band authentication, with possible removal of that condition for documented controls and an additional premium. 24 Virtual Care lists healthcare professional liability, technology liability, cyber, media, general liability and products/completed operations for digital-health businesses. Life Sciences offers product, professional and general liability through BioSecure, NutraGuard and WellTech forms for different life-sciences exposures. 26,27 North American Commercial Property targets mid-sized and large commercial properties on an excess and surplus lines basis. Product Recall – Manufacturing Risk and Response separately addresses consumer goods, component parts and consumables, including product-removal and related income-loss costs. 28,29 BeazleyOne Environmental combines general, professional and contractors’ pollution liability for environmental-service firms, and lists hired and non-owned auto. US Marine offers hull and marine liability on primary and excess bases; this does not establish general corporate umbrella availability. 30,31 Beazley offers representations and warranties coverage for acquisitions. Its US Specialty Programs business works through managing general agents, program administrators and specialized brokers on professional, general, product, manufacturers’ E&O, cyber and allied-medical liability programs. 25,32 The posted Digital Media Tech application says liability coverage is claims-made and reported: the claim must be made and reported within the applicable policy terms. It also warns that claims expenses reduce the liability limit and are subject to retentions. 15 |
| Application process | At-Bay describes a broker workflow of completing an application, adjusting limits and retentions, reviewing documents, selecting an effective date, and satisfying contingencies and signature requirements before binding. Brokers can also email submissions to underwriting. An online quote is not itself bound coverage. 6,4 | Beazley describes MediaTech placement through third-party platforms or email. Its posted application requests the business’s services and products, employee count, US and non-US revenues, financial statements and expected business changes. A submitted application does not establish acceptance or an effective policy. 14,15 |
| Fees and compensation | Stance access uses an Embedded Security Fee and Endorsement, while MDR is separately purchased. Security costs should be distinguished from the insurance premium and any broker charges. 7 Commission rates, broker compensation arrangements and a complete placement-fee schedule were not disclosed in the reviewed product, platform and US terms pages. This does not establish that commissions or fees are absent; request an itemized quote and compensation disclosure. 2,6,10 | The reviewed MediaTech product page, application and US website terms do not disclose a buyer-specific premium, broker commission rate or fee schedule for a MediaTech placement. Obtain an itemized quote and the placing broker’s compensation disclosure. 14,15,19 |
| Servicing and renewals | At-Bay Stance offers vulnerability monitoring, fraud defense, employee security training and access to cyber advisors. Access is tied to the policy’s Embedded Security Fee and Endorsement; optional managed detection and response (MDR) is a separate purchase from At-Bay Security, LLC. 7 At-Bay markets Stance MDR for endpoints and email, plus managed extended detection and response (MXDR) spanning endpoint, email, identity and cloud. It says MDR is optional for insurance and available beyond its policyholders. Coverage enhancements and premium credits have qualifying conditions. 7 At-Bay describes broker dashboard access to active policies and renewals, with rapid and manual renewal paths. Its platform page says rapid renewals bind automatically 15 days before expiry; buyers should confirm enrollment, terms and change deadlines with their broker. 6 | Beazley publishes a MediaTech renewal application. The reviewed renewal form and product page do not establish a guaranteed renewal, dedicated account manager, or turnaround commitment for policy changes. 17,14 Full Spectrum Cyber for small businesses combines Beazley Breach Response with security tools and services. Beazley describes incident-response coordination and discounted vendor services. Its myBeazley quote-and-bind route is for brokers handling accounts below $35 million in revenue and limits no higher than $5 million; these are cyber-route criteria, not MediaTech eligibility rules. 22 |
