Does Insurance Cover 401(k) Lawsuits?

Fiduciary liability insurance may respond to certain 401(k)-related claims alleging a covered breach or administration error. A plan’s bond addresses different dishonest-handling losses; check the complaint and both contracts.

Participants can sue over benefits or alleged fiduciary breaches under ERISA, and a 401(k) dispute can involve claims against the plan, sponsor, committee members, or other fiduciaries. Fiduciary liability insurance may respond if the allegations, insureds, plan, timing, and requested relief fit its terms. A DOL-required fidelity bond is different: it protects the plan against certain losses from fraud or dishonesty by people handling plan property.

For an existing demand, preserve it and follow the applicable policy’s notice and consent requirements promptly. For a renewal, schedule the 401(k) and all relevant insureds; compare prior-acts and prior-known-matter provisions, defense costs, benefit-payment or restitution terms, and limits. Check whether the ERISA bond remains adequate too. Do not assume that having a bond, D&O, or a general “management liability” package resolves every 401(k) allegation.
