Does Fiduciary Liability Cover ERISA Lawsuits?

A policy may cover some ERISA claims alleging a covered wrongful act, but it does not cover every ERISA lawsuit or every remedy. Read the insuring agreement and exclusions.

ERISA permits participants to sue over benefits and alleged fiduciary breaches, and DOL also enforces ERISA. A fiduciary liability policy may respond to covered allegations under its grant of coverage: the Travelers specimen, for example, includes certain claimed ERISA fiduciary-duty breaches. Coverage still turns on defined insureds, plans, claims, timing, loss, limits, and exclusions.

An ERISA case seeking overdue benefits, plan corrections, penalties, or injunctive relief can raise different coverage questions from a damages claim alleging imprudent plan management. Check the specific policy’s definition of claim, claims-made and reporting provisions, prior-matter terms, defense-cost rules, and treatment of penalties or restitution.
