Kentucky presumes a product was not defective when injury, death or property damage occurs more than five years after its first consumer sale or more than eight years after manufacture. The presumption is rebuttable by a preponderance of evidence, and a separate presumption applies when design, manufacturing and testing complied with then-prevailing standards or the state of the art. What to Watch for in Kentucky
The presumption has two different age triggers
KRS 411.310 presumes a product was not defective if harm occurred either more than five years after the first consumer sale or more than eight years after manufacture. The presumption is rebuttable by a preponderance of evidence, so preserve both dates rather than tracking only a warranty or retail-sale date. 1
Standards compliance creates a separate presumption
The statute separately presumes no defect if the product’s design, manufacturing methods and testing conformed to generally recognized and prevailing standards or the state of the art in effect when the design was prepared and the product manufactured. Preserve applicable standards and dated design, test and production records. 1
Alteration and maintenance history can change the liability analysis
KRS 411.320 measures manufacturer liability against the product’s original, unaltered condition; it includes failure to observe routine care and maintenance as an alteration, but excludes ordinary wear and tear. An unauthorized change or a user’s failure to exercise ordinary care is a defense when it substantially caused the occurrence. 2
Personal-injury filing time may be short
Kentucky generally requires an action for injury to a person to be brought within one year after the cause of action accrued. Record incident and discovery dates promptly; a product-age presumption does not replace this separate limitation period. 3
