# Product liability in Kentucky

Kentucky presumes a product was not defective when injury, death or property damage occurs more than five years after its first consumer sale or more than eight years after manufacture. The presumption is rebuttable by a preponderance of evidence, and a separate presumption applies when design, manufacturing and testing complied with then-prevailing standards or the state of the art. Kentucky also addresses product alteration, routine maintenance and user care; personal-injury actions generally have a one-year period.[^1][^2][^3]

**Coverage:** [Product liability](/coverage/product-liability) · [Kentucky](/coverage/states/kentucky)

## What Is Product Liability?

Product liability can cover claims that a product you make, import, distribute or sell injured someone or damaged property. If your business handles products, describe every role in the supply chain and ask how the quote treats product damage and recall costs. [Read the national Product liability guide](/coverage/product-liability).

## What to Watch for in Kentucky

### The presumption has two different age triggers

KRS 411.310 presumes a product was not defective if harm occurred either more than five years after the first consumer sale or more than eight years after manufacture. The presumption is rebuttable by a preponderance of evidence, so preserve both dates rather than tracking only a warranty or retail-sale date.[^1]

### Standards compliance creates a separate presumption

The statute separately presumes no defect if the product’s design, manufacturing methods and testing conformed to generally recognized and prevailing standards or the state of the art in effect when the design was prepared and the product manufactured. Preserve applicable standards and dated design, test and production records.[^1]

### Alteration and maintenance history can change the liability analysis

KRS 411.320 measures manufacturer liability against the product’s original, unaltered condition; it includes failure to observe routine care and maintenance as an alteration, but excludes ordinary wear and tear. An unauthorized change or a user’s failure to exercise ordinary care is a defense when it substantially caused the occurrence.[^2]

### Personal-injury filing time may be short

Kentucky generally requires an action for injury to a person to be brought within one year after the cause of action accrued. Record incident and discovery dates promptly; a product-age presumption does not replace this separate limitation period.[^3]

## Who Regulates Insurance in Kentucky

**Kentucky Department of Insurance.** The Kentucky Department of Insurance licenses agents and insurers, monitors the insurance market, and accepts complaints about insurance companies and agents. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% on Kentucky-home-state premiums and other premium consideration; separate 1.8% surcharge on eligible risks located in Kentucky, subject to statutory exceptions; applicable local-government premium tax may also apply When Kentucky is the insured's home state, the state tax is 3% of premium and other consideration treated as premium; local-government premium taxes may also apply. A separate 1.8% surcharge generally applies to Kentucky risks, but state law exempts multistate nonadmitted risks and specified government and nonprofit premiums. The broker must make a diligent effort to place coverage with an admitted carrier before using surplus lines.[^7][^10][^8][^9][^11]

## Providers With Documented State Licenses

These providers publish a national listing for Product liability; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Kentucky; [check the regulator’s license lookup](https://insurance.ky.gov/ppc/Agent/Default.aspx) and confirm state availability for your business when requesting a quote.

- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^18]

## Questions to Ask Before You Buy in Kentucky

1. Can our records establish both the manufacturing date and first consumer-sale date for each product at issue?
2. Which safety, design and testing standards applied at design and manufacture, and where are the supporting dated files?
3. Have routine maintenance, repairs, ordinary wear, unauthorized modifications or user directions changed the product from its original condition?

## Product Liability in Kentucky: FAQ

### What product ages trigger Kentucky’s presumption?

The presumption that a product was not defective applies when the harm occurred either more than five years after first consumer sale or more than eight years after manufacture. It can be rebutted by a preponderance of the evidence.[^1]

### What deadline applies to a Kentucky personal-injury action?

KRS 413.140 generally requires an action for injury to a person within one year after accrual. The claim-specific accrual date should be assessed separately from the product-age presumptions.[^3]
