Product liability in Idaho

What to Watch for in Idaho
Ten years creates a presumption, not an automatic cutoff
For harm caused more than ten years after first delivery, Idaho presumes that the product’s useful safe life expired. A claimant can rebut that presumption only with clear and convincing evidence; the underlying useful-safe-life defense otherwise turns on whether the seller proves by a preponderance that the harm occurred after that life expired. 1
Several statutory exceptions can preserve claims
The ten-year presumption does not apply where a longer safe-use warranty was made, qualifying intentional misrepresentation or fraudulent concealment substantially caused harm, harm followed prolonged exposure, the injury-causing aspect was not reasonably discoverable until later, or harm occurring within ten years manifested after that period. 1
The separate two-year period still matters
A claim under Idaho’s product-liability chapter may not be brought more than two years after accrual under Idaho Code § 5-219. For personal-injury and death claims, § 5-219 generally measures from the occurrence, act or omission; its narrow fraudulent-concealment provision has specified relationship, knowledge and timing conditions. Do not assume every product claim waits for discovery. 1,2
