Nevada’s current limitations chapter lists a two-year period for actions seeking damages for personal injury or death caused by another’s wrongful act or neglect, subject to exceptions and any more specific statute. Nevada separately provides a ten-year outside period for certain injury or death claims tied to construction defects in improvements to real property, but expressly excludes actions against a person for a defect in a product from that construction provision. Identify whether the alleged harm concerns a product or a construction improvement, the injury and accrual facts, and whether a contract or specialized statute changes the analysis. What to Watch for in Nevada
The two-year period is a claim-category rule
NRS 11.190(4)(e) lists two years for an action to recover damages for personal injury or death caused by another’s wrongful act or neglect. The chapter’s opening rule is expressly subject to a specific statute and the paragraph contains exceptions. It should not be used as a universal clock for warranty, contract, property-only, or specialized claims. 1
Product defects are excluded from the construction-repose section
NRS 11.202 establishes a ten-year outside period for specified personal-injury or wrongful-death claims arising from deficiencies in construction of improvements to real property, but subsection 3( b )(2) expressly says that section does not apply to an action against any person for a defect in a product. Classification matters when a product is installed into or associated with a building. 2
Separate the product and improvement allegations
A claim involving an installed component may allege a defect in the product, deficient construction, or both. Preserve product identity and version, installation and maintenance records, who supplied and installed it, and the alleged failure mode so counsel can identify the potentially applicable rule. 1,2
Comparative fault has a product-specific allocation exception
For injury or property-damage actions, NRS 41.141 generally bars recovery when the plaintiff’s comparative negligence is greater than the opposing parties’ combined negligence. But subsection 5(e) preserves any joint and several liability that applies to injury or property damage resulting from a product manufactured, distributed, sold, or used in Nevada. Preserve incident, warning, instructions, and user-conduct records; ask counsel how the asserted theories affect allocation. 3
Ask about the actual policy language
These limitation statutes do not decide whether a policy covers a particular occurrence, claim, entity, or expense. Ask the broker to address the actual products-completed-operations wording, insured entities, defense-cost treatment, limits, and exclusions. 1,2
