What to Watch for in Utah
Match policy dates to Utah’s discovery and outer periods
A malpractice action generally must begin within two years after discovery or reasonable discovery of injury, but no later than four years after the alleged act, omission, neglect or occurrence. Foreign-object and fraudulent-concealment exceptions have separate rules. Confirm how the policy’s retroactive date and report requirements track care and claim dates. 1
The $1 million threshold concerns personal assets
For individual health-care providers, the 2025 statute permits collection from personal income or assets when the court finds a policy limit below $1 million, with separate willful/malicious or fraud findings also listed. It does not command all providers to buy insurance; ask whether the provider’s policy meets the threshold and whose coverage counts. 2
Most actions have a pre-suit process
The statute requires at least 90 days’ notice before initiating a malpractice action and, except for dental defendants, a certificate of compliance. Utah also provides for prelitigation review; ask who coordinates defense and notices without assuming the process expands policy coverage. 1
Use the claim’s arising date for the noneconomic limit
Utah Code §78B-3-410 sets a $450,000 noneconomic-damages limit for causes arising on or after May 15, 2010 and excludes punitive damages from that limit. This is not a total-loss limit or a policy limit. 1
Utah’s placement backstop is conditional
The insurance commissioner may hold a public hearing and find professional liability coverage is not readily available in a specific area before implementing a joint-underwriting plan. The statute does not establish automatically available coverage or a patient-compensation fund; verify whether a current plan exists for the provider and location. 3

The Utah Insurance Department regulates licensed insurance companies and producers, offers a public licensee search, and accepts complaints about property/casualty insurance.
