What to Watch for in Missouri
Check practice, facility and staffing relationships
Chapter 538 defines a broad provider class and extends §538.210 to some defendants who provide, refer, coordinate, consult on or arrange care. Identify the practice entity, staffing relationships and individual clinicians on the policy. 1,2
Use the relevant injury and legal-version dates
The cap schedule changes annually on January 1, and the applicable statutory version can depend on when the cause accrued. Missouri Supreme Court precedent rejects retroactive application of a new cap to a cause accruing before its effective date; preserve injury, accrual, settlement and verdict dates separately. 2,3
Do not carry forward the struck common-law cap
The Supreme Court struck down the earlier cap in a common-law malpractice action. SB 239, approved June 24, 2015 and generally effective August 28, 2015, replaced common-law health-care claims with a statutory cause; §538.210 has since been amended. Do not carry the earlier decision forward as a ruling on the later statute, and confirm the legal version for older claims. 2,4

The 2026 figures cap noneconomic damages in defined cases, not insurer defense costs or contractual limits. Compare occurrence/claims-made structure, defense inside limits, retro date and any tail on the actual policy. 2,3
