What to Watch for in New Hampshire

  • Calendar reserve establishment separately

    The New Hampshire reporting clock begins when the insurer establishes a reserve, not when care occurred, a claim was first received, or a matter settled. Ask the carrier which matters were reported and on what date. 1

  • The reportable medical-injury definition is broad

    The statute includes adverse outcomes arising in professional services from negligence, error, omission, no informed consent, warranty/contract, failure to diagnose, premature abandonment and equipment failures. Do not assume only paid malpractice suits count. 1

  • Out-of-state matters may still be reportable

    Section 329:17 covers reservable claims coincident with medical injury that take place in New Hampshire or another state for a physician Board licensee. Confirm the carrier’s reporting ledger across state lines. 1

  • Do not plan around the repealed screening-panel chapter

    New Hampshire repealed RSA 519-B effective July 1, 2023. Older references to a statutory medical-injury screening panel should not drive a current claim calendar. 2
