Medical malpractice insurance in North Carolina
North Carolina’s physician-board statute distinguishes an individual licensee from the insurer. A licensee without professional liability insurance, or insured by an entity not owned and operated within North Carolina, must report an award or settlement affecting practice within 30 days; insurers and specified funds have their own Board-reporting duties. What to Watch for in North Carolina
Identify who has the Board reporting duty
For an Article 1 physician licensee, the statute places the 30-day individual report on an uninsured licensee or one whose liability insurer is not owned and operated within North Carolina. Insurers and certain trust funds separately report covered settlements, judgments and for-cause cancellation or nonrenewal. Confirm your reporting path instead of assuming the carrier handles it. 1
Keep licensing reports separate from policy notice
The 30 days run from the award or settlement for a report to the Medical Board. They do not extend or replace the contract’s notice, cooperation or consent-to-settle terms. Follow the insurer’s policy deadlines when a claim or incident arises. 1
Track the separate applicant/licensee report
G.S. 90-5.3 separately requires applicants and licensees to report every malpractice judgment or award, plus single or aggregated settlements of at least $75,000 for incidents on or after May 1, 2008. It includes payments from personal funds and calls for incident date, place and specialty. Maintain this history even when the insurer also reports under §90-14.13. 2

Surplus-lines tax and stamping office
Reported tax rate: 5% of gross premium, less return premium, plus 0.4% NC Stamping Office fee for ordinary filed placements When North Carolina is the insured’s home state, surplus-lines tax is 5% of gross premium less return premium; ordinary broker-placed filings also carry a 0.4% stamping fee, while risk-purchasing-group and independent-procurement filings follow separate procedures. A diligent search is generally required; an exempt commercial purchaser may bypass it only after the broker discloses the admitted-market protection difference and receives the purchaser’s subsequent written request.
