What to Watch for in Nevada
A correction demand has a 90-day knowledge trigger
Nevada § 41.336 applies to libel published in a newspaper and slander by radio or television broadcast. A demand must be written, served on the outlet at its place of business, identify the statements claimed to be libelous or slanderous, and be made within 90 days after the plaintiff knows of the publication or broadcast. 1
The correction rule measures conspicuousness and actual malice
If a qualifying demand is not answered within 20 days with a correction in substantially as conspicuous a manner, the plaintiff may seek general and special damages; exemplary damages require proof of actual malice, which the statute says cannot be presumed from publication. A sufficiently conspicuous correction before demand has the same effect. 1
Do not apply the special correction rule to every format
Nevada’s two-year libel and slander limitations rule is separate from the correction procedure. Section 41.336 names newspaper publication and radio or television broadcast; it does not identify web articles, hosted video, or client advertising as covered formats. 2,1
