What to Watch for in Florida
Send a pre-suit demand to the insurer promptly
Florida's five-day period is the minimum notice a plaintiff must give before filing a qualifying suit; it is not a grace period for your policy notice. Forward a demand immediately and follow the policy's reporting instructions. 1
Assign an owner for correction requests
Florida's correction deadlines vary with publication schedule and can be as short as 10 days after service of notice. For publications issued less often than monthly, a correction may appear in the next issue only if notice is served at least 45 days before that next issue. The damages limitation also depends on good faith, an honest factual mistake, reasonable grounds to believe the statement, and a full and fair correction; a retraction does not automatically meet those conditions. 2
Treat the SLAPP rule as procedure, not insurance wording
