Media liability in Idaho

Idaho Code §5-219 places actions for libel and slander in a two-year limitations category. The subsection does not itself state a publication-discovery rule. A media business should preserve the original publication, later versions, correction history, and dates, then ask counsel how timing applies to its facts and a broker how the proposed policy treats related claims. 1,2

What Is Media Liability?

Media liability can help pay defense costs for claims about content you create or distribute, such as allegations of defamation or infringement. Consider it if you publish or produce content for your business or clients; match the quote to each activity. Read the national Media liability guide.

What to Watch for in Idaho

  • Two-year statutory period

The official Idaho Code lists an action for libel or slander among actions subject to a two-year period. Do not treat that as a promise that every claim has two years from the same event: §5-219(5) does not specify the accrual answer for a particular publication. 1

  • Keep a version timeline

Because §5-219(5) names libel and slander but does not address online edits, republication, or discovery, keep dated copies of the original story, material revisions, and any correction or removal. Ask Idaho counsel which event matters for the claim at hand. 1,2

  • Ask about related-claim wording

When comparing media policies, ask the broker to explain how the wording treats multiple demands about related publications, notice, and prior knowledge. Idaho’s limitations statute does not answer those contract questions. 1

  • A filing period does not define insurance

Section 5-219 is a court-filing rule. It says nothing about whether an insurer must defend, whether a particular outlet or activity qualifies for a policy, or which defense expenses are payable; check the actual forms. 1
