What to Watch for in Minnesota

  • Calendar the two-year libel and slander period

    Minnesota includes libel and slander among actions generally commenced within two years. Track publication and claim dates, then compare them with the policy’s separate claim-reporting and retroactive-date terms. 1

  • The retraction statute is written for newspaper libel

    Section 548.06 applies to libel published in a newspaper. It requires the plaintiff to serve the publisher at its principal place of publication with notice identifying the statements and requesting withdrawal; failure to publish the specified retraction within one week permits a claim for general as well as special damages. Even after a retraction, general damages may remain unless the defendant shows the publication was made in good faith and under a mistake as to facts. Candidate publications have added placement and election timing conditions, and the section excludes libel imputing unchastity. 2

  • A broadcast defense is limited to another person’s statement

    Section 544.043 concerns a defamatory statement in a radio broadcast made by someone other than the station, its agents, or employees, and requires due care. Its text does not create a general defense for online video, print, or a broadcaster’s own statement. 3
