What to Watch for in Texas
Check the Designated Area
TWIA commercial property eligibility is limited to its designated catastrophe area: the 14 first-tier coastal counties and parts of Harris County east of Highway 146. Confirm your property address qualifies before treating TWIA as an option. 1
Fill the Other Peril Gaps
TWIA covers windstorm and hail only; its policy does not cover flood or other perils such as fire or theft. Keep a separate property policy or other coverage for the remaining losses your business needs to insure. 4,3
Document a Private-Market Declination
For new TWIA coverage, an authorized insurer writing wind and hail in a first-tier coastal county must either refuse coverage for the property or offer coverage materially more restrictive than TWIA, such as a higher deductible or no replacement cost. Surplus-lines carriers do not qualify. Ask your agent to retain the insurer name, declination date, and proof; TWIA requires a new declination every three years for renewal. 6
Locate the Windstorm Certificate
TWIA requires a Certificate of Compliance for eligible properties unless a stated exception applies; TDI says many new builds, roof replacements, major repairs, and alterations require inspection. Review the building’s construction and repair history with your broker and confirm the applicable WPI certificate for the property. 1,7,2
Check the V-Zone Flood Condition
TWIA requires NFIP flood coverage only when all three conditions apply: any part of the property is in a V, VE, or V1–V30 zone; NFIP coverage is available; and the structure was constructed, altered, remodeled, or enlarged after September 1, 2009. Ask your broker to verify each condition for the insured structure before treating flood coverage as a TWIA eligibility requirement. 5
