At-Bay vs
CFC
Compare At-Bay and CFC technology products for a pre-revenue software company, including IP scope and California product restrictions.
Introduction
A pre-revenue software company can incur customer obligations before it has a mature revenue history. CFC explicitly includes pre-revenue businesses in its technology audience and describes technology, cyber, media and intellectual-property elements. At-Bay describes combined technology E&O and cyber. The useful comparison is whether each proposed form accepts the business and addresses the contract’s specific liabilities. 14 15 2

Key Differences Between at-Bay and CFC
Intellectual Property Is Not One Coverage Promise
CFC’s technology package includes IP-related language, while it separately markets intellectual-property insurance. The separate product’s scope should not be imported into the technology package. Ask which rights and allegations the quoted form addresses, especially if a customer asks for broad infringement indemnity. At-Bay’s technology description similarly needs supporting wording for the obligation at issue. 15 27 2
California Restrictions Must Stay Attached to Their Product
CFC’s management-liability materials decline California-domiciled businesses and standalone EPL in that program. That restriction is not evidence that all CFC technology coverage is unavailable in California. The reviewed public documentation leaves the technology route unresolved, as it does At-Bay’s current product acceptance. Ask a broker for product-specific confirmation on both sides. 24 17 5
Both Require the Actual Placement Details
CFC’s MGA role and its references to Lloyd’s arrangements do not identify every policy’s insurer. At-Bay’s historical own-paper announcement also cannot settle the current issuer. CFC’s technology application and At-Bay’s platform describe broker-mediated underwriting, so a founder should plan for a completed submission rather than infer automatic acceptance from the audience description. 17 16 11 6
What to Confirm in Quotes
Provide revenue stage, planned launch, contracts and IP obligations. Request the proposed forms, California route, insurer, accepted professional services and any separate IP policy. Compare cyber response services by included tasks and charges, not by an unverified promise of incident outcomes. 20 7
Service Comparison
At-Bay vs CFC Insurance: documented services and availability
| Criteria | At-Bay | CFC |
|---|---|---|
| Business role | At-Bay offers cyber, technology errors and omissions (Tech E&O), and miscellaneous professional liability insurance. Its disclosed producer, At-Bay Insurance Services LLC, is a property and casualty agency and surplus lines broker; its website says coverage is underwritten by non-admitted insurers. 1,5 | CFC is a specialist insurance provider operating an MGA model: a managing general agent performs underwriting functions for insurance capacity providers. Its disclosures identify CFC Underwriting Limited and the U.S. producer CFC USA, Inc.; the CFC brand should not be treated as the name of every policy’s insurer. 18,17 |
| Customer focus | At-Bay markets Tech E&O to technology businesses. Its current product page states primary and excess appetite up to $5 billion in revenue and $10 million in limits; the broker-platform route has lower published ceilings of $100 million in revenue and $3 million in limits. These are appetite ceilings, not guaranteed offers. 2 A September 2023 Tech E&O appetite PDF still accessible on At-Bay’s site has lower revenue and limit ceilings than the current product page and lists restricted classes including autonomous AI. It should not be treated as current eligibility guidance; ask underwriting for the applicable appetite version. 12,2 | CFC markets its technology products to startups, midsize companies and multinationals, including businesses before they generate revenue. That stated audience does not establish acceptance of a particular business. 14 |
| Availability | At-Bay lists California P&C and surplus-lines license number 0L73812 for At-Bay Insurance Services LLC. This is a company disclosure, not an independently checked California Department of Insurance record or confirmation that a particular product is available. 5 The reviewed product and licensing pages do not establish current California eligibility for a specific startup, product and issuing insurer. At-Bay warns that products may not be available in every state, and MPL has state restrictions; obtain California placement confirmation through the broker. 5,2,3,4 | CFC reports that CFC USA, Inc. holds producer licenses in all 50 states and Washington, D.C., plus excess and surplus lines authorization in California, Georgia, New York and Texas. It identifies its California licensing name as CFC General Insurance Agency, Inc. This is CFC’s disclosure, not an independently checked California license record or confirmation of product eligibility. 17 CFC’s January 2026 U.S. management-liability brochure lists California-domiciled business and standalone employment practices liability under risks it declines. This restriction is specific to the described management-liability offering; it does not establish a California exclusion for every CFC product. 24 The reviewed U.S. technology page, brochure and application do not establish the currently available admitted or surplus-lines route for a particular California startup. CFC announced admitted technology E&O in 2023, but the reviewed materials do not supply a current California product eligibility schedule. 14,15,16,42 |
| Application process | At-Bay describes a broker workflow of completing an application, adjusting limits and retentions, reviewing documents, selecting an effective date, and satisfying contingencies and signature requirements before binding. Brokers can also email submissions to underwriting. An online quote is not itself bound coverage. 6,4 | The U.S. technology application asks a senior staff member to complete it and return it to the company’s insurance broker. It requests revenue, funding, subsidiaries, products, major contracts, security controls, IP procedures and claims history. CFC’s Connect portal separately supports broker trading and describes a broker appointment process. 16,19 |
