Can Ecommerce Companies Get IP Insurance?

Ecommerce businesses can ask about IP cover for brand, content, product, or licensing disputes, but marketplace activity and online sales do not guarantee coverage.

An ecommerce company may rely on brand names, product images, descriptions, designs, and goods sourced from other businesses. Those activities can raise copyright, trademark, or patent questions, but the policy must define which claims it covers. FTC guidance notes that some cyber third-party coverage may include copyright or trademark losses related to cyber claims; this is not a blanket promise for ordinary marketplace disputes.

Tell the insurer where products are sold, whether they are private label or licensed, who creates site content, and what suppliers promise about IP rights. Ask whether the proposed IP or media form covers listings, advertising, platform takedowns, and claims involving third-party goods. Check whether coverage is restricted to named websites, marks, or products and how contractual or intentional conduct exclusions apply. Compare defense and enforcement, limits, retention, and notice rules. Keep licenses and supplier records available and review the actual endorsements before assuming online operations are within scope.
