IP Insurance vs. Media Liability: What Is the Difference?

IP insurance is organized around specified rights and disputes; media liability is tied to defined media activities and claims. The forms can overlap, but their exclusions and triggers differ.

Media liability is commonly structured around defined media activities and allegations involving content. One Hiscox specimen form grants coverage for specified copyright and trademark claims but excludes patent and trade-secret infringement and certain software copyright claims. That example shows that a media form may cover some content-related IP allegations while excluding other rights; it is not a universal market rule. Dedicated IP products can separately address defense, enforcement, or contractual indemnity.

Compare the definition of media activities and covered offenses with the IP policy's scheduled rights and products. Check whether the claim comes from publishing, advertising, software, or business operations generally. Review exclusions, prior knowledge, defense costs, settlement consent, limits, and retentions in both forms. Ask whether either policy has an other-insurance clause or an endorsement that changes the result. If enforcement of your own patent or trade secret matters, confirm that option specifically; media liability may be designed for content claims rather than pursuit of rights.
