Who Needs Intellectual Property Insurance?

Businesses with valuable IP, products that could face infringement allegations, or meaningful enforcement needs may consider it. Fit depends on exposure and policy scope.

A business may assess IP insurance if it depends on software, brands, inventions, designs, content, or confidential know-how, or if an infringement allegation could be costly to defend. The UK Intellectual Property Office says coverage may not suit every business and suggests understanding the rights owned and risks faced. That is UK guidance, not a US requirement. The NAIC lists IP infringement insurance as an available business liability coverage type.

Identify the business's key rights, products, and license obligations. Consider both directions: another party may accuse the business of infringement, or the business may need to enforce its own rights. Review customer contracts, markets, planned expansion, and known disputes. Then compare the actual grants and exclusions in media, cyber, general liability, professional liability, and any dedicated IP quote. Ask whether defense, enforcement, and contractual indemnity are included. A broker can help evaluate options, but only the issued policy wording shows whether a specific right or claim is covered.
