Fiduciary liability addresses covered benefit-plan fiduciary or administration claims; EPLI addresses employment-practice allegations such as discrimination or wrongful termination. Check for separate coverage grants and exclusions.

A dispute involving employee benefits does not automatically become an employment-practices claim, and an employment allegation does not automatically involve a benefit-plan fiduciary duty. Travelers describes fiduciary coverage in connection with retirement or health plan management; it describes EPL coverage for claims such as termination, discrimination, harassment, and retaliation. These are typical product scopes from one insurer, not guarantees about every form.

Compare both actual policy forms for insureds, claim definitions, defense arrangements, limits, retentions, and exclusions. If the complaint alleges retaliation tied to plan participation, wrongful denial of benefits, or both, ask the broker how each form would treat it and whether related claims provisions apply. Confirm whether the coverages share an aggregate or have separate sublimits. Do not rely only on a package name or a certificate summary.
