Kansas includes performance guarantees in its statutory insurance classifications and separately addresses surety and bond obligations. A promise to answer for another party’s performance may need a different analysis from indemnity for your own loss. Ask who receives the promise, what duty is guaranteed, and whether the document is a bond or insurance policy. 1
Debt and creditor protections have separate treatment
Kansas law separately lists bond or note payments and certain debtor obligations among classes that do not receive the same guaranty-association treatment. Those provisions do not automatically apply to a policy triggered by a nonfinancial contract event.
