# In Kansas, match the policy promise to its statutory insurance class

Kansas’s statutes distinguish insurance protecting a policyholder’s own loss from specified bonds and creditor obligations. They do not say that a contract-frustration label determines the class. Ask the insurer to identify the class and explain how the actual promise and payment trigger fit it.[^1][^2]

**Coverage:** [Contract frustration](/coverage/contract-frustration) · [Kansas](/coverage/states/kansas)

## What Is Contract Frustration?

Contract frustration may fit your business when an international contract is exposed to political disruption or government action. If your main risk is a customer who cannot pay, compare trade-credit coverage instead. [Read the national Contract frustration guide](/coverage/contract-frustration).

## What to Watch for in Kansas

### A performance guarantee can raise a bond question

Kansas includes performance guarantees in its statutory insurance classifications and separately addresses surety and bond obligations. A promise to answer for another party’s performance may need a different analysis from indemnity for your own loss. Ask who receives the promise, what duty is guaranteed, and whether the document is a bond or insurance policy.[^1]

### Debt and creditor protections have separate treatment

Kansas law separately lists bond or note payments and certain debtor obligations among classes that do not receive the same guaranty-association treatment. Those provisions do not automatically apply to a policy triggered by a nonfinancial contract event. Have the broker identify the covered obligation and explain whether it is debt, a guaranteed performance duty, or a distinct insured loss.[^1][^2]

### Association protection follows statutory class rules

Kansas’s guaranty-association statute applies to classes listed in the insurance code while excluding specified sections, including some bond and creditor-obligation classes. This is an insolvency backstop question, not a decision about the insurer’s policy coverage.[^2]

## Who Regulates Insurance in Kansas

**Kansas Insurance Department.** The Kansas Insurance Department regulates companies selling policies in Kansas for solvency and compliance with state law. Its consumer assistance team reviews written complaints, contacts the appropriate parties and requests corrective action when it finds a Kansas insurance-law violation.[^3][^4][^8][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums for surplus-lines insureds whose home state is Kansas; the 3% rate applies beginning with taxable year January 1, 2024 For surplus-lines business whose insured's home state is Kansas, the licensed agent must collect and pay a 3% tax on gross premiums less returned premiums; the 3% rate applies beginning with the taxable year starting January 1, 2024. For an exempt commercial purchaser, the surplus-lines producer need not file the signed diligent-search statement after disclosing that admitted-market insurance may or may not be available and may provide greater protection and oversight, then receiving the purchaser's subsequent written request.[^6][^7]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://sbs.naic.org/solar-external-lookup/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Kansas

1. What exact loss does the form insure, and does it promise performance or payment by someone else?
2. Which Kansas insurance class will the insurer use, and what wording or filing supports that classification?
3. If insolvency protection matters, which statutory class makes this policy eligible for the Kansas association?

## Contract Frustration in Kansas: FAQ

### Does calling a Kansas policy contract frustration make it a performance guarantee?

No. Kansas law has distinct classifications for performance guarantees and other insurance obligations; the product label alone does not establish which applies. Ask for the insurer’s classification and its basis.[^1]

### Does Kansas guaranty-association eligibility confirm coverage for the contract event?

No. The association statute concerns claims after insurer insolvency and applies by statutory class. The policy wording controls the insurer’s promise.[^2]
