Contract Frustration Insurance in Indiana

For an Indiana buyer, the policy’s state of issuance can affect which regulator and law handle questions or disputes. Confirm the named insurer, issuance state, placement channel, and actual policy form before comparing a proposal; Indiana’s surplus-lines rules describe a placement route but do not establish that this coverage is available through it. 1,2

What Is Contract Frustration?

Contract frustration may fit your business when an international contract is exposed to political disruption or government action. If your main risk is a customer who cannot pay, compare trade-credit coverage instead. Read the national Contract frustration guide.

What to Watch for in Indiana

  • Check the state that issued the policy

The Indiana Department of Insurance says Indiana law generally does not apply to policies issued in another state and directs policyholders to that state’s regulator. If your business or project is in Indiana but the proposed policy is issued elsewhere, identify the issuing state before deciding where to ask for help or which state’s rules to review. 1

  • Verify whether the proposal uses surplus lines

Indiana describes surplus-lines companies as eligible for use when a surplus-lines agent cannot obtain the particular class of insurance, or the full amount needed, from insurers licensed in Indiana. Ask the broker to identify the actual insurer and placement route, and explain what the route means for your policy and recourse. This state rule does not show that a contract-frustration policy is available in Indiana or that a specific proposal qualifies. 2

  • Ask for the exact form before relying on a product label

Indiana makes policy forms, rates, and rules available through its public filing resources, including SERFF filings made public under state law. Request the insurer’s legal name, policy form number, and any filing reference, then compare the issued wording with the disruption, loss, waiting-period, and documentation terms described in your quote. Public access to a filing does not establish that it applies to your policy or that a loss will be covered. 3

Who Regulates Insurance in Indiana

Surplus-lines tax and stamping office

Reported tax rate: 2.5% of gross premium when Indiana is the home state Indiana’s surplus-lines premium tax is 2.5% when Indiana is the insured’s home state. Surplus-lines policies are outside Indiana guaranty-fund protection; before you buy, confirm the insurer’s identity and financial strength with your broker. 7,8,9,10

Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. Check the regulator’s license lookup and confirm availability with a provider when requesting a quote.

Questions to Ask Before You Buy in Indiana

  1. Which legal entity will issue the policy, in which state will it be issued, and which insurance department should handle a policy complaint?
  2. Will placement be admitted or surplus lines? If surplus lines, what insurer and licensed surplus-lines broker are involved, and what does that channel mean for this policy?
  3. What are the policy form number and filing reference, and can I review the complete wording, endorsements, and exclusions before binding?

Contract Frustration in Indiana: FAQ

Should an Indiana buyer always contact IDOI about a contract-frustration policy? 1

No. IDOI says it regulates insurers and producers licensed in Indiana, but Indiana law generally does not apply to policies issued in another state; for an out-of-state-issued policy, IDOI directs consumers to that state’s regulator. Confirm the issuing state and named insurer first. 1

Does Indiana’s surplus-lines list show that this insurance can be bought in Indiana? 2

No. The list explains when an eligible surplus-lines company may be used by a surplus-lines agent: when the particular insurance class or full amount cannot be procured from insurers licensed in Indiana. It does not identify a contract-frustration product or establish availability for a particular buyer. 2
