What you’ll need

  • 01

    Rights you own

Patents, trademarks, copyrights and other rights, and the products that rely on them.

  • 02

    Rights you license

Technology or content you use under license, which the quote has to treat.

  • 03

    Defense or enforcement

Whether you need protection against infringement allegations, help pursuing copiers or both.

  • 04

    Products and activities

What you make and sell that could be the subject of a dispute.

  • 05

    Customer and license agreements

Any promise to defend or reimburse a customer for an IP claim.

  • 06

    Existing disputes and notices

Demand letters or conflicts already in play, which have to be disclosed.

  • 07

    Current coverage

Your expiring terms, including any IP part of another policy.

What affects your price

  • 01

    Rights and products insured

More rights and more products make a broader policy.

  • 02

    Defense, enforcement or both

Each is a separate part with its own cost.

  • 03

    Limits and retention

Higher limits cost more, and a higher retention can lower the premium.

  • 04

    Dependence on IP

A business whose products rest on a few key rights has more at stake.

  • 05

    Existing disputes

Known conflicts can be excluded or affect the price.

Common questions

Will I be covered if I sue someone who copied me?

Only if the quote includes enforcement. A defense-only quote doesn’t pay for your own lawsuit.

Does it pay for promises I made to a customer?

Not automatically. A policy that protects your business doesn’t necessarily pay for obligations you took on in a contract, so show those to your broker.

How is this different from media liability?

Media liability addresses claims over content you publish. IP insurance addresses patent, trademark and copyright disputes. We check which fits your concern.

Will my broker understand IP coverage?

That varies by broker. Spot works alongside yours, takes no commissions on premiums and can help you find one who writes IP.
